Terms of Service

Please read these Terms carefully. They explain the rules for using our website and the basis on which we provide our design, development, and marketing services.
01Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Tellpull website, as well as any design, development, marketing, or related services provided by Tellpull LLC (“Tellpull,” “we,” “us,” or “our”).
By visiting our website, requesting a quote, booking a consultation, or engaging us for a project, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
02Our Services
Tellpull provides web design, web development, application development, digital marketing, and related consulting services. The specific deliverables, timeline, and price for any engagement are defined in a separate written proposal, statement of work, or quote (the “Project Agreement”).
Where these Terms conflict with a signed Project Agreement, the Project Agreement controls for that engagement.
03Quotes, Proposals & Project Scope
Quotes and proposals are valid for thirty (30) days from the date issued unless stated otherwise. A project is considered confirmed once you have approved the Project Agreement in writing and paid any required deposit.
Work requested beyond the agreed scope (“out-of-scope work”) will be quoted separately and is not included in the original price. Examples of out-of-scope work include:
- Additional pages, features, or integrations not listed in the Project Agreement
- Revisions beyond the agreed number of revision rounds
- Content creation, copywriting, or photography not expressly included
- Significant changes to direction after a stage has been approved
04Payment Terms
Unless otherwise stated in the Project Agreement, projects require a deposit before work begins, with the remaining balance due according to the agreed payment schedule. Final deliverables, source files, and deployment are released once payment has been received in full.
Invoices are due within the period stated on the invoice. Late payments may result in paused work and may incur a reasonable late fee. All prices are exclusive of applicable taxes unless stated otherwise.
05Client Responsibilities
A successful project depends on timely collaboration. You agree to provide content, feedback, approvals, access credentials, and any other materials we reasonably request without undue delay.
You are responsible for ensuring that any content you supply — including text, images, logos, and data — is accurate, lawful, and that you hold the necessary rights to use it.
06Revisions & Approvals
Each project stage includes a defined number of revision rounds as set out in the Project Agreement. When you approve a stage, the project moves forward based on that approval. Requests to revisit an approved stage may be treated as out-of-scope work.
If we do not receive feedback within a reasonable period after delivering a stage, that stage may be deemed approved so the project can continue.
07Intellectual Property & Ownership
Upon receipt of full payment, ownership of the final deliverables created specifically for your project transfers to you, except for third-party assets and any pre-existing tools, frameworks, libraries, or components owned by Tellpull or third parties.
Tellpull retains the right to display completed work in our portfolio and marketing materials unless we agree otherwise in writing.
08Third-Party Services
Projects may rely on third-party platforms and services such as hosting providers, payment processors, scheduling tools, analytics, and APIs. Your use of those services is subject to their own terms, and Tellpull is not responsible for their availability, performance, or pricing.
09Confidentiality
Each party agrees to keep confidential any non-public business, technical, or financial information disclosed during an engagement and to use it only for the purpose of delivering the project.
10Warranties & Disclaimers
We provide our services with reasonable skill and care. However, our website and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our website or any delivered work will be uninterrupted, error-free, or free of harmful components.
11Limitation of Liability
To the fullest extent permitted by law, Tellpull will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of our website or services.
Our total aggregate liability for any claim arising out of an engagement will not exceed the total fees paid by you to Tellpull for that engagement.
12Termination
Either party may terminate an engagement in accordance with the Cancellation Policy and the Project Agreement. Upon termination, you agree to pay for all work completed and expenses incurred up to the termination date.
13Governing Law
These Terms are governed by the laws of Jamaica, without regard to its conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Jamaica.
14Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
